Conditions of Use

1. Acceptance and incorporated documents
The owner and provider of the website is Miguel Herrero Oña, NIF 08033379P, with postal address at C/José Sánchez Pescador num 7, 28007 - Madrid - Spain. The contact email for privacy and abuse matters is abuse@bacan.com.
These conditions govern the use of Bacan.com and the ordering of hosting, domains, email, servers, reseller services, web design, support and related services.
By ordering, renewing, testing or using a service, the customer accepts these conditions and declares that they have sufficient legal capacity. If acting on behalf of a company, the customer declares that they are authorized to bind it.
- The acceptable use policy, privacy and cookie policy, domain terms, specific product terms and any current technical annexes form part of the contract.
- If documents conflict, the document that is specific to the relevant matter will prevail.
2. Account creation and accuracy of data
- The customer must be of legal age and provide correct, up-to-date and verifiable data.
- The customer must keep an operational email address, preferably one that does not depend on the contracted service itself.
- Bacan may request identity, payment, company or eligibility checks. Failure to respond may lead to cancellation or suspension.
3. Orders, provisioning and changes
Services are provisioned after payment confirmation, technical availability and anti-fraud checks. Some products depend on third parties and may require additional time or validation.
Bacan may reject orders that are suspicious, incompatible with the acceptable use policy, technically unfeasible or contrary to applicable law.
4. Billing, taxes and renewals
- Services are normally provided on a prepaid basis for the contracted billing cycle.
- Taxes will be applied according to applicable law and tax location.
- Renewals may be automatic if the product allows it and the payment method is active.
- Non-payment may lead to suspension, non-renewal, domain loss or termination of the service.
5. Suspension and deletion for non-payment
Bacan may suspend expired or unpaid services after a reasonable handling period. Once a service is deleted, data recovery is not guaranteed.
The customer is responsible for keeping their own backups and for cancelling services before expiry if they do not wish to renew them.
6. Withdrawal, cancellations and refunds
European Union consumers may have a legal right of withdrawal under applicable law. This right may not apply once the service has started with express consent or where products are personalized or executed immediately, such as domains, certificates, licences or technical work already performed.
Refunds, where due, will be made through the original payment method or as customer credit if the original method does not allow it. Domains, registration fees, restorations, third-party licences, SSL certificates, services already provided and custom work are not refundable unless required by law or due to an error attributable to Bacan.
7. Resources, fair use and backups
Use of the services is subject to technical limits and the acceptable use policy. In shared environments, the customer must not negatively affect other users or platform stability.
Bacan backups, where available, are a best-effort operational measure and do not replace the customer's own backups.
8. Email, security and content
- The customer is responsible for content hosted, published, sent or stored through the services.
- The customer must keep applications, CMS installations, plugins, passwords and permissions properly protected.
- Hosting unlawful, abusive or unacceptable-use-policy content is prohibited.
- Bacan may intervene in the event of security risks, abuse, malware, spam, phishing or valid authority requests.
9. Domains
Bacan acts as a technical or commercial intermediary before registrars and registries. Domain allocation, renewal, transfer or restoration depends on external policies and real availability.
Domains are also governed by Bacan's specific domain terms and the policies applicable to each extension.
10. Third-party services
Some services may include software, licences, payment gateways, panels, registries, certificates, CDN, analytics or other external providers. Those services may be subject to their own terms and limits.
11. Maintenance and force majeure
Bacan may perform scheduled or urgent maintenance. In critical security or stability incidents, Bacan may act without prior notice where necessary.
Bacan is not liable for events outside its reasonable control, including provider failures, external network outages, registry decisions, attacks, disasters, conflicts, legal restrictions or force majeure.
12. Liability
Bacan will provide the services with reasonable professional diligence. Unless mandatory law provides otherwise, Bacan is not liable for loss of profit, loss of business, reputational loss, indirect damage or damage arising from the customer's configurations, content or decisions.
Bacan's aggregate liability for a specific service is limited to the amount paid by the customer for that service during the affected period.
13. Data protection
Bacan will process personal data according to its privacy and cookie policy. The customer is responsible for personal data contained in their websites, databases, emails and hosted applications.
14. Applicable law and jurisdiction
These conditions are governed by Spanish law. Unless mandatory law provides otherwise, the parties submit to the courts of Madrid.
15. Changes
Bacan may modify these conditions for legal, technical, commercial or operational reasons. The current version will be published on this page and material changes will be communicated by reasonable means where necessary.
